You missed the point where the game is not T2 nor GBX's property. They only own the Duke Nukem IP, not any of the materials that would be created by this team. You don't know what you're talking about.

Here is the truth. Those early screens did exactly what they were supposed to do: create excitement and help in the formation of a team for making the mod. But there is not much to get excited about at this point, and the mod will probably never be completed (I'm not passing judgment on the project by saying that, but as a matter of statistics the odds are not good).

Strange, with little to no effort (just the duke4.net forums search) anyone can find a minimum 5 threads of the same type project, with the same people making the same 'it will never happen' comments. Not a Good Luck, Hope it works out for you, barely any supportive comments, mostly negative. But if someone posts a work in progress using the eduke-mapster-build system - holy crapola! the same commenter's are ready to add tips and even lend a hand. You want links to threads as proof - bite me! find them yourself. I have personally experienced this myself and will not stand idly by while another dev is beaten up because he's trying something new.
My pledge to anyone on this board - if you are working on a non-eduke/mapster/build engine game and are willing to ignore the negative posters, I will be happy to help anyway I can.
PS. my 1st game, long time ago, in a gaming world far far away

used to work on quake, some unreal, hooked on Unity now - especially the new one Unity 3.
Unity 3 - now publishes to Browser based games, Wii, Android, iPhone, Pc, Mac, xbox360 and PS3
and has a free version.
Unity may be a little different from unreal or bsp editing, really its a lot like build but actually has a 3rd dimension to it.
I have other stuff I like to work on but they have nothing to do with gaming

And to be fair, the Eduke ( not Duke ) community put a lot of work in the latest Eduke32. To post here about using another engine is risky business. I think it's passion for Eduke and not hate against another game engine.
And, redoing Duke in great detail is boring work for Dukers, well for me. So let them do the work – we download, and play. By that time Eduke32 is Eduke64 with more TCs. Win-win scenario, methinks.

but yes i can understand peoples angst here, given that over the years anything of this nature has been bitch slapped by legal BS, and a couple of screenshots scores a license, anyone here with any UT mapping skills could have done the same a year or 2 ago, but they didnt bother given the reactions of similar projects or even suggesting to attempt such a thing.
Personally though i would have more fun playing through something like that than making it

Non-commercial means he can't sell the game, basically it gives Fresch permission to use Duke Nukem in his game if its released freely. Copyright protection stops Gearbox, or any one else for that matter, from using material created by him or anyone else involved in this project this project; which means Gearbox can't just sell what they created because Fresh and the others involved in the project own it (its the law that never changes).
Basically all gearbox did was give permission to use Duke Nukem, but due to copyright laws Gearbox can't sell their work. So you are wrong.

Also, you guys realise that he only released what he did because people were asking for it, right? He initially posted a thread with a couple screenshots of the roof of E1L1 and asked what people thought and if they'd be interested. There was a flood of posts asking for more and a video so that's what he gave them. He didn't just jump in and do this to try and get attention.
