Yes they do, but 2K is the publisher
Expanding on what Descent said:
I have to inform you that 2K's DNF production is by license , without any rights to the game other than being a publisher , publishing the game's DVDs (media, marketing, advertisments , global reach , customer support , statistical data mining , brand's reputation/respect ) , your worries or fears can be invalidated as of now , that's because T2 will not and CANNOT change DNF;; a lot of us quit pwnding on gearbox because ... even tho it's not 3DR style , (teen ass bitch marketing cheap photoshop) but they focus on the game and they confirmed a lot of PC friendly features (dedicated servers , no 3rd party platforms on PC , etc ... ) but we "pawn" on 2K's stupid cover box art.
2K is a publisher by it self doesn't mean anything, it only means that not a lot gamers have idea how gaming industry works , mostly because , they don't want you to know and they don't tell you , major stuff and announcements happen in press releases which aren't even intended to be for fans , smart gamers pick those things up to understand how the company works if or how it is trustable and the , 3DRealms forums guys about 100 or 50 of them , they know a lot ... jobi and kaiser soze and KO gilligan (and many more) (and ofcourse duke4.net) , i think those are with duke forever and they knew about the fact that the trailer is coming , you should have visited dukewatch , ... early indications such as hints and posts , but most importantly hard to find , updating of the forums and it's servers , which would mean they're expecting to reveal something but are preparing it of course before it goes online (flip of a switch at a certain date) ... so yeah.
The fundamental fact is , 3DR never lost as media may portray it , 3DR didn't got the best scenario , but im putting this "as close to best" since, they didn't sold the company , and they didn't sold the IP to the publisher , 2 fundamental points. Upon that , gearbox has ~22%(counting triptych) of ex-3DR developers (working on DNF) (that's 2009 refugees + CEO + triptych , there was a graphical presentation how many 3DR employees went somewhere , maybe one some guys here will link to it in the 3DR forums (this is going to be hard to find, best to start searching from may 2009 timeframe and on , it's definitely not in late 2010) ... so i only have a visual memory , about 60% of 3DR dev team left to join gearbox , some ID software and some Epic games (and other but smaller studios ) , some of them unaccounted for and these were triptych guys , 9 of them , + about let's say ~20 + 1 ex-3DR Pitchford , that created gearbox software , + 1 ex-3DR that joined Pitchford as he opened the new company at the time. About 30 people are ex-3DR guys that work on DNF at gearbox currently , got more accurate info than this ?
Things aren't exactly as the contexts says , GB said they found a way through the legal process to keep then-unknown Triptych games (ex 3DR 9 devs) working from homes , but the reality is that this wasn't an issue after all , they could have worked ANYHOW / ANYWHERE without finding permissions , because just after the lawsuit was filled by T2 , T2 was
denied temporary restraining order , why ? Because 3DR owned Duke Nukem , and now Gearbox owns duke nukem , there is again nothing 2K can do , they have NO POWER , ZERO, everything that 2K produces must be validated and approved by gearbox software.
Here's the catch , why the heck gearbox
accepted the "jersey shore" cover art :/ ask randy xD ; this was confirmed by 2K Elizabeth.
Owning the publishing rights doesn't mean a dog's poo in terms of any control whatsoever.
