I'm going to assume it is only the Duke titles that are problematic in this bundle since the Shadow Warrior IP was handed over before the Anthology was made.

There's no reason to assume Devolver suddenly owns the rights to the original SW.

There are hints in the agreement between Shadow Zilla Holdings LLC and GHI Media LLC that that is the case, but the version that was filed with the USPTO is heavily redacted. But it does say that SHadow Zilla will not retain any rights and there is a to a six month sell off period.
