Joe Bryan Turner just locked all Duke Nukem subforums on the 3DR forums and posted this:

As far as I'm concerned, 3D Realms had this coming. At least Gearbox only finished off the game and built on what 3DR already did.

This is why GB and 3DR was so quiet
This is why they were trimming negative threads a 3DR forums
The court case was settled - 3DR was either ordered to hand over the IP or take a purchase offer from Take2-Gearbox

All duke related portions of the 3DR forums are closed - DNF, duke3d, Manhat proj, eduke - all of it

Ya, if gearbox wants to control all DNF media under the Gearbox/2K/Take 2 banner.
Typically companies don't squash the little guys.

Figuring this is going to become the 'go to' place for old-Duke, eDuke, pre-gearbox DNF threads
What would you do if you were Gearbox, all that $$$ on the IP and now you have a PR monser on your hands.
Most managers will want total control, step1 3DR, step2 facebook/twitter/etc, step3 - ??? duke4.net?
They already had 3DR, GB, Scott and Joe gagged.
Even on launch day 'When its done' 3DR couldn't even update its website
GB couldn't even confirm it himself via twitter

I suspect anything pre-DNF can stay as is.
DNF page will end up a forwarder to gearbox site
anything Duke on 3DR site will end up static pages.

Duke Nukem Forever website is live. And 3D Realms' logo is on the bottom. Maybe they still own the rights? Or maybe they're just acknowledging all the work they put into it before passing it on.

Never noticed this before but, it appears Scott did cut the cord with GB and 3DR. Betting Scott made a deal to keep selling rights to this one Duke game and let 3DR and GB hang out to dry after GB burned through all that money ant time.

This is a fan site, it doesn't violate anyone's copyright. Neither does eduke, which is GPL. The HRP is a bit more complicated, but I see no reason for concern. I don't recall Id trying to shut down the legacy Doom community when Doom 3 came out.

The HRP had permission from 3DR, the then holder of the copyrights on Duke Nukem and various characters in the game, to reproduce those characters so long as they were used exclusively with the DUKE3D.GRP file from Duke Nukem 3D.
So, yes, it is complicated and it would be wise of us to inquire with Gearbox about rights to the HRP.

Perhaps Gearbox has the rights to the Duke Nukem franchise for a limited period of time?
It'd only make sense with them developing Duke Begins and Duke Nukem Forever.
Another possibility could be that since Gearbox and 3D Realms have a close relationship Gearbox bought the Duke IP off 3D Realms and they have an arrangement for 3D Realms to buy it back once they get enough money from the sales of DNF to do so.

What makes you think that 3DR is getting any money from sales of DNF?

Face it, Gearbox owns Duke Nukem and 3DR is left with less but has money now to start up its publishing gig again.

Considering 3D Realms created Duke Nukem and spent 13 or so years developing the game chances are they'll get money out of it.

Well, they're either going to get royalties from the sales, or the projected sales were factored into whatever was paid for the rights to the game. Either way, 3DR gets something for the sales of the game.

Merely speculation, until word comes from 3DR/Gearbox, it's all just speculation. Sure, it holds water, but you don't know whats behind the scenes. Regardless, I was talking more about people saying "SURELY THEY HAD TO GIVE UP THE IP IN COURT!!11one," or implying that Apogee was just created to fuck over George Broussard.

I do think that it's sad that 3D Realms has lost such a large part of its identity, and I wish it hadn't come to that. However, Gearbox was founded by people who worked on Duke 3D at 3DR, and if there's any company that could do justice to the Duke property after 3D Realms, it's them. They've displayed a very strong sense of respect and passion for Duke as well. Brian Martel (one of the Gearbox co-founders who worked on Duke 3D and an early version of DNF) explained in an interview that they quickly took the initiative after the layoffs at 3DR, and even arranged to have some of the people who had been working on the game stay together to help them take DNF to completion. So, it's unfortunate to see 3D Realms lose their creation, but the bright side is that Duke is with people who are familiar with the property, and truly care about making it the best game it can be and finally getting it out to the shelves. :D

I have sort of a 'bitter-sweet' feeling about the news today. Feeling great about DNF being announced at PAX. In fact it gave me chills and goosebumps, even though I always knew we'd have the game at some point. But when I visited the forums at 3DRealms, I sank right down in my chair and felt really down. After all these years of watching and waiting at the door of Duke's home, I expected the greatest day in gaming history would be made there. Now, WID has a new meaning: Well It's Done! and it makes me sad to think that 3DRealms as well as its relation to DNF is done as well.

I felt the same way, and it was stunning and disappointing to see that 3DR and Duke Nukem were being dissociated to that degree (not even being allowed to post about Duke on 3DR for some strange reason). But, the thing that really made me feel better was knowing that so many of the people who worked at 3DR are still developing the game. :D
