Do you think 3D Realms would really want to touch Duke Nukem ever again with Gearbox willing to bite them again at any moment?

Yes but if they don't even want to touch material from over 20 years ago because of Gearbox, why would they even attempt to use Duke in any way in something new?

We have JSJ Easter Eggs in our next game (And there were some in Bombshell as well)

Would a harmless single line easter egg really be that bad, especially considering the amount of crap Gearbox steals (oh sorry, references) to use as easter eggs in Borderlands?

If GBX authorized it it wouldn't be a big deal. But a line ain't really that copyright infringing unless it was ripped from a Duke game. There are plenty of easter eggs like that in other games. Serious Sam is a great example.

The phrase is "JSJ easter egg". Not "Duke easter egg".
I'm sure JSJ is free to act in Duke's voice anyway he likes as long as it is not called "Duke Nukem".

He's allowed to call himself "Duke" but not "Duke Nukem" for anything not done for the franchise.

It would be dishonest at best of the holder of one of the biggest parodying and easter-egg filled franchises ever made to not allow other franchises to parody it in turn.
