If, say, I'd make Build game with 100% custom content (sound, music, graphics, levels), am I legally allowed to sell it? To be clear, it would use eDuke only as engine, no content either from shareware or retail version of Duke would be used, nor any content related to an existing IP.

You would have to negotiate an agreement with Ken. TerminX would likely be the one to talk to.
