They are remaking the game for modern platforms and may have the source code to reference the code.

The re-make that you guys did was good but doesn't hold the same nostalgia value as the original. It would be great to see some people make mods for it. Also would be fun to play the original game on modern systems.

Still, it would be nice to see the source code being released to the public. Since the actual game was made freeware years ago, there really is no reason why the source shouldn't be released. It's just a matter of getting all the involved parties to consent.
And I wouldn't worry too much about the state of the source code. The Blake Stone - Planet Strike source code was incomplete, but some smart people were able to get it to compile properly -- while also reconstructing the missing bits for Aliens of Gold. Doom's source was released without the sound libraries, but the fans were able to reconstruct/replace the sound code anyway. If you have the skills and the time to port an old game to modern systems, you will be able to do that regardless of the state of the original source.

My guess is that 3D Realms sold the IP but retained the right to sell the original game, similar to what happened with the Shadow Warrior IP.
