Obviosuly we don't even know the settlement details yet, the game may even have to be scrapped for all we know.

You are a little too late on this one. Jobi and others have already jizzed all over their computer screen at the news.
It is good to know that 3DR won't go out of business over a law suit with TakeTwo (because they weren't going to win the case) but until details from the settlement or something of that ilk is revealed, we have nothing to get excited about.

Because Jobi, there are such things as NDA's, and you know, corporate privacy. Maybe Scott and George dont want to talk about it, yes?
Yes.

We could find that it is still a year to hire a new crew, get them up to speed on the engine and get the game done... if they have the money to actually do that.
And all during that time, Jobi and the other 'lifers' will be jumping up and down and declaring that DNF will be out next week.
Sigh.

Based on Scott's comments we do know the game has continued development.
Based on a statement released by someone at 3D Realms we know they will likely not go back to being an internal developer.
Ergo... We really dont know what DNF's situation is right now. It could be a few months from release, imminently close, or way off. It's anyones guess.

It's definitely complete enough to show off a trailer of it. Surely.

Based on what evidence? The 2009 portfolio/leak stuff? Assuming since that time things were changed and updated to conform with the new teams "style" it may not quite be ready for prime time yet, we just plain don't know.
