That is absolutely right. But I´m just curious. Most people speculate about the case and noone can find any valid information. And that is why I´m asking...

Neither do we. It's not how these things work. It's a very long and involved process and things change all the time and there can be long delays at any point in the process. Suits like this can take years to resolve, depending on the willingness of the parties to come to a settlement. A very very small percentage of cases ever actually end up in court in front of a judge or jury. It's a long drawn out process where the only winners are the lawyers.

I too would like to see the court documents from the federal courts. It IS public information. I just don't know how to get to it. Anyone seen it/know how to get to it?

I looked around a bit and had no luck. We've already got our answer from George though, the case is still ongoing. Obviously the "disposed" blurb was only referring to the case being moved to federal court.

What totally baffles me is Scott's repeated teases and blurbs about "wishing he could talk" as it seems he's sitting on some major news. Well, it's definately not the case being settled.

If there's no settlement before the trial, I think the game is toast. ;)

That is a stupid assumption.
If the game was done, they would have released it because it would have prevented this law suit to begin with.

If 3drealms wins the court case over Take 2, how do they finish the game? With what money?
George has painted himself into a corner by letting the team go and basically saying he has no money.

to a DNF sequel.

Scott is trumpeting that Take 2 should be bought out. ;)

I was referring to T2 winning, as I hope they do. If T2 wins I believe it will be finished by another company.

If I correctly understand if Take 2 Wins, DNF may come out, but only in xBOX 360. That being the case, I would rather have no DNF then a retarded DNF port on a console.

I know I have said this a million times, but I would be shocked if someone wasn't working on the game right now. Lawsuit or not, I think the game is currently being worked on by an unknown developer. This might sound cliche, but the best defense is a good offense. If 3DR takes the initiative and has someone finish the game before the suit hits court, T2 doesn't have a case. As far as funds, I don't see this as a big issue. I don't think the money Scott and George got from Prey is just sitting in a bank account. They sold the IP for a reason. It will be interesting to see what the new game informer reveals about the lawsuit.

Maybe the next duke game will be a courtroom battle. There's tons and tons of court tv series already, time to widen the market to games. Duke vs T2 @ court. Who wins!?

You'd get to taunt the judge every time he makes a bad decision and kick t2 law-dudes where it really hurts.

Only for wii with balance board, so you can really get those kicks in.

Off topic but just noticed something of a coincidence and little interest.

Negotiations fell through for DNF between 3DR and Take 2 on May 1st 2009. This is known as May Day, which is a distress signal which means help me. It comes from the french m'aidez.

For anyone interested, I got the latest Game Informer today and it's really just GI appealing to the authority of IP attourney (Merchant & Gould) Eric Child. He discusses a lot of what's already been discussed, potential outcomes, comes up with a lot of the same numbers people already have (assuming things don't settle, 2012, 2013). The conclusion from Eric was that it'd be best if they settled, of course, but he also mentioned that there could be enough bad blood to keep things going for a long time.

What were the 2012, 2013 years mentioned for? How long the case could be dragged out via appeals?

As I've been saying, we need to be hoping for a settlement that will include getting the game finished. If the case goes to trial, the game is dead.

Just a quick thought.

There was a 5 million dollar amount being thrown around that 3dr apparently asked Take 2 for to complete DNF. When Take 2 balked,
George let the team go.

Now, is it possible that 3dr had let's say 2 million dollars laying around and was able to pick up an outside developer to finish the game?

I presume the 5 million amount was the money needed to pay 3dr employees so they could get to the end of development. By cutting the staff,
could it have possibly "brought" the completion amount down for a third party like Gearbox or Humanhead to finish it?

One thing that bugs me is... that GB promised they would give them royalties for the game when it's released as an excuse for paying them low salaries...now that the team was let go, GB doesn't have to pay any royalties to them.

Whoever would theoretically be devloping it would need enough cash themselves to sustain operations (minus possibly the pocket change 3DR could hand them), because their employees need to be paid too. That means if you're going to look for potential candidates you can only look at those that are truly independent (meaning don't need anyone to fund them for developement). That limits your pool signifficantly. You can throw HH right out the door for example, I'm suspecting Gearbox too (IIRC people were let go and project(s) axed or at least put on hold).

Unless you think HL EP3 is taking so much time because they're finishing DNF ;) there aren't too many self financing triple-A FPS devs. There is (or rather was) id, which aside from that I don't ever see them doing such a thing are now owned by a publisher anyway.

For the hypothetical case I think 3DR needs to scrape together enough cash to pay someone (which would have a bitter after-taste, that they should have done that effort before letting everyone go), or settle with T2 and convince them to pay a third party which T2 has enough confidence in to finish it.
